Introduction and acceptance

These Terms of Service govern access to and use of kompetr.com, the Kompetr web application, related services, and any future official Kompetr mobile application that refers to these Terms. Kompetr is currently operated by Jonasz Adamski. By creating an account, accepting an invitation, purchasing a subscription, or otherwise using the service, you agree to these Terms and to the Privacy Policy and Cookies Policy. If you do not agree, do not use Kompetr.

About Kompetr

Kompetr is an organizational tool for private, amateur sports games among friends, colleagues, and other invited participants. It allows users to manage participants, invitations, schedules, attendance, availability, teams, results, player statistics, rankings, player comparisons, game history, and in-app communication. Kompetr is not a sports federation, official competition organizer, sports club, venue, referee, coach, medical provider, betting service, or public sports-content platform. Kompetr does not organize, supervise, or control the physical games played by users.

Key terms

In these Terms, “Kompetr,” “we,” “us,” and “our” mean the Kompetr service operated by Jonasz Adamski. “User” means anyone who accesses or uses Kompetr. “Participant” or “Player” means a user included in a private sports group. “Administrator” means the user who creates or controls a private group. “Co-administrator” means a user who has been given additional permissions to help manage that group. “User Content” means information or material submitted, entered, uploaded, or generated through the use of Kompetr, including profile photos, names, chat messages, chat images, schedules, attendance, availability, results, statistics, rankings, team information, and notes. “Subscription” means a paid plan that provides access to specified premium features for a billing period.

Eligibility and accounts

You must be legally capable of agreeing to these Terms. Kompetr is not directed to children under 13. Users in the European Economic Area must normally be at least 16 unless a lower age is validly permitted by the law of their country and any required parental authorization has been obtained. You must provide accurate account information, keep it reasonably up to date, use only an account you are authorized to control, and protect your login credentials. You are responsible for activity carried out through your account unless the activity results from circumstances for which you are not responsible. Notify hello@kompetr.com promptly if you suspect unauthorized access to your account.

Private groups and invitations

Kompetr is designed for private groups rather than open public competitions. A person normally joins a private group only through an email invitation approved by an Administrator or Co-administrator. An existing Participant may request that another person be invited, but the invitation is sent only after the required approval. Invitations are intended only for the named recipient and must not be transferred, automated, misused, or used to send spam. Receiving or accepting an invitation does not guarantee continued membership, participation in a particular game, access to every feature, or a permanent role within the group.

Administrators and Co-administrators

Administrators and Co-administrators may manage private-group settings, invitations, membership, schedules, attendance, availability, teams, results, statistics, and other information according to the permissions available in Kompetr. They must use these permissions lawfully, fairly, and only for the legitimate purposes of the private group. They are responsible for checking information they enter, correcting errors where reasonably possible, managing internal decisions, and ensuring that they have an appropriate basis to add or manage information relating to Participants. Kompetr is not responsible for selection decisions, team choices, scoring judgments, scheduling decisions, participation decisions, or disputes within a private group.

Participation and sports-related risks

Participation in sport is voluntary and may involve risks including injury, illness, property damage, travel risks, venue conditions, weather, equipment failure, and interpersonal disputes. Users are responsible for deciding whether they are fit to participate, seeking medical advice where appropriate, following applicable laws and venue rules, using suitable equipment, and arranging any insurance they consider necessary. Kompetr does not verify a Participant's identity, fitness, health, skill, availability, equipment, venue, safety arrangements, or insurance. Kompetr does not guarantee attendance, balanced teams, fair play, accurate officiating, or any particular game outcome.

User Content and permissions

You retain any rights you hold in your User Content. You grant Kompetr a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, technically adapt, transmit, display, moderate, and make User Content available to authorized users only as reasonably necessary to operate, secure, maintain, support, and improve the service and to comply with legal obligations. This licence normally ends when the relevant content is deleted from active systems, except where temporary backups, lawful retention, anonymized records, evidence of misuse, or legal obligations require continued retention. You must have the rights and permissions necessary to submit User Content and must not disclose another person's personal, confidential, or protected information without an appropriate basis.

Visibility and accuracy of group information

Profile details, profile photos, attendance, availability, results, statistics, rankings, player comparisons, game history, and chat content may be visible to authorized Participants in the same private group. Some information may be entered by Administrators, Co-administrators, or other Participants and may be incomplete, subjective, or inaccurate. Kompetr provides tools for recording and displaying this information but does not independently verify every entry. Users should normally raise correction requests with the relevant Administrator or Co-administrator. Users may contact Kompetr where the issue concerns account data, privacy, unlawful content, abuse, or misuse of the service.

Acceptable use

You must not use Kompetr to violate the law or another person's rights; harass, threaten, discriminate against, exploit, or impersonate another person; publish unlawful, hateful, sexually explicit, violent, defamatory, deceptive, privacy-invasive, or infringing material; upload malware or harmful code; send unsolicited invitations or spam; scrape, harvest, copy, or systematically extract information without permission; interfere with the security, availability, or operation of the service; gain unauthorized access; evade technical, Subscription, or usage limits; manipulate results, statistics, rankings, or attendance dishonestly; create fraudulent accounts or transactions; or use Kompetr for betting, gambling, or unauthorized commercial activity.

Reports, moderation, and content removal

You may report unlawful content, abuse, harassment, privacy concerns, intellectual-property concerns, or other violations of these Terms by contacting hello@kompetr.com. Your report should contain enough information for us to identify and assess the issue. We may investigate, preserve relevant evidence, restrict visibility, remove content, limit invitations or features, suspend an account or private group, or take no action where a report is unsupported. Where reasonably possible and legally appropriate, we may explain a significant moderation or suspension decision and provide a way to challenge it. We may act without prior notice where necessary to address an urgent legal, security, safety, fraud, or abuse risk.

Free, Pro, and Elite plans

Kompetr may offer Free, Pro, Elite, trial, promotional, or other plans. The Free plan currently lets players participate in up to 2 competitions and includes one 60-day admin trial for 1 competition. Pro and Elite do not include a free trial. The features, limits, eligibility requirements, duration, billing interval, and price applicable to a plan are shown in the service or at checkout. Premium features may include increased limits, additional management tools, advanced statistics, player comparisons, or other functionality. We may add, remove, or change features and limits for future billing periods. We will not remove a material paid feature during an already-paid period without a valid reason and any remedy required by applicable consumer law.

Paddle and the contract of sale

Paid Subscriptions purchased through Paddle are sold by Paddle as Merchant of Record. Paddle is responsible for the checkout transaction, payment collection, applicable transaction taxes, invoicing, fraud prevention, chargeback handling, transaction refunds, and buyer-facing payment support under the terms and policies presented by Paddle. The Paddle entity identified at checkout is the seller for the payment transaction. Kompetr remains responsible for providing access to the purchased Kompetr features. You must provide accurate billing information and comply with the terms presented during checkout. Kompetr does not receive or store your full payment-card details.

Trials, renewal, cancellation, and plan changes

A trial or promotional period may be subject to eligibility requirements, feature limits, an expiry date, or a requirement to provide a payment method. Unless the plan description or checkout states otherwise, a paid Subscription renews automatically for the same billing interval until cancelled. The applicable renewal price and billing interval are displayed before purchase and may also be available through the customer portal. You can cancel your Subscription at any time through the available Kompetr billing settings or through the Paddle customer portal. Your Premium features remain available until the end of your current billing period, and no further charges will be made after cancellation. Cancelling a Subscription does not automatically delete your Kompetr account. Upgrades, downgrades, billing-frequency changes, promotional codes, credits, and prorations are handled according to the options and amounts displayed before confirmation. A downgrade may reduce features or limits when it becomes effective.

Prices, currencies, and taxes

The applicable price, billing interval, currency, and taxes are displayed before you confirm a purchase. Because Paddle acts as Merchant of Record, Paddle calculates and collects applicable VAT, sales tax, or similar transaction taxes and provides the relevant receipt or invoice. Exchange rates, bank charges, card-provider fees, and other third-party charges are outside Kompetr's control. We may change prices for future purchases or renewal periods, subject to advance notice and any rights required by law. A price change does not retroactively alter a completed billing period.

Consumer withdrawal rights

Consumers may have a statutory right to withdraw from a distance contract, including a 14-day withdrawal right in the European Union and European Economic Area, subject to applicable conditions and exceptions. During checkout, you may be asked to request immediate supply of the digital service and acknowledge the consequences for your withdrawal right. The precise effect depends on the type of digital service, the stage of performance, the information and consent provided at checkout, Paddle's applicable buyer terms, and mandatory law. Nothing in these Terms removes a withdrawal right that cannot lawfully be excluded.

Refunds

Refund requests for a Paddle transaction should be submitted through the support or refund route provided by Paddle or by contacting hello@kompetr.com with the account email and transaction or invoice reference. Paddle processes transaction refunds as Merchant of Record under its applicable refund policy. Payments already made are generally non-refundable, except where required by law, stated at checkout, approved under that policy, or in cases of billing errors. Cancellation, non-use, removal from a private group, a downgrade, or dissatisfaction with another Participant does not automatically entitle you to a refund or prorated credit. This section does not limit any remedy available for a defective, unavailable, or non-conforming digital service.

Digital-service conformity and consumer remedies

Where mandatory consumer law applies, Kompetr must supply the digital service in conformity with the contract and provide updates, including security updates, where legally required. If a paid service is not supplied, is materially defective, or does not conform to the contract, you may be entitled to have conformity restored, receive a proportionate price reduction, terminate the relevant contract, obtain a refund, or receive another statutory remedy. The available remedy depends on the circumstances and applicable law. These rights are not excluded by limitations elsewhere in these Terms.

Kompetr intellectual property

Kompetr, including its software, interface, design, databases, text, graphics, branding, logos, and other materials supplied by us, is owned by or licensed to the operator and is protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, and revocable right to use Kompetr for its intended purposes. You may not copy, sell, license, reverse engineer, modify, distribute, frame, mirror, or create derivative works from Kompetr except where applicable law expressly permits it or we provide written permission.

Third-party services

Kompetr relies on or may link to third-party services, including Paddle, Google services, email providers, hosting and infrastructure providers, security services, app stores, and external websites. Their services are governed by their own terms and privacy notices. We are not responsible for a third party's independent service, content, availability, security, or decisions. This does not limit any responsibility Kompetr has under mandatory law for selecting or using a provider as part of the Kompetr service.

Availability, maintenance, and changes

We aim to provide a reliable service but do not promise uninterrupted or error-free availability. Maintenance, updates, infrastructure failures, internet conditions, security incidents, third-party outages, bugs, delays, or data-synchronization problems may affect Kompetr. We may modify, limit, suspend, or discontinue functionality where reasonably necessary for security, legal compliance, maintenance, technical development, or product operation. We will provide notice where required by law and use reasonable care to avoid unnecessary disruption to paid users.

Suspension, termination, and account deletion

You may stop using Kompetr at any time and may request account deletion through account settings or by contacting privacy@kompetr.com. Cancelling a Subscription and deleting an account are separate actions. We may restrict or suspend an account, private group, invitation function, Subscription access, or User Content where we reasonably believe there has been a breach of these Terms, unlawful conduct, abuse, fraud, payment misuse, a security risk, repeated substantiated complaints, or a legal requirement. We may terminate access for a serious or repeated breach. Where appropriate, we will consider the nature, frequency, and impact of the conduct and provide notice or an opportunity to respond unless immediate action is justified.

Effect of termination

When an account is deleted or access ends, your right to use Kompetr ends. Personal data is handled as described in the Privacy Policy. Historical game information may remain only in anonymized or de-identified form where reasonably necessary to preserve the records of a private group. Provisions that by their nature should continue, including intellectual property, lawful data retention, payment obligations, dispute provisions, disclaimers, and liability limitations, remain effective. Termination does not remove rights or liabilities that arose before termination.

Service disclaimer

Kompetr is provided on an “as available” basis. To the extent permitted by law, we do not guarantee that all information entered by users is accurate, that automated team suggestions will be objectively fair, that Participants will attend, that every feature will always be available, or that the service will meet every user's requirements. Nothing in these Terms excludes statutory guarantees, digital-service conformity obligations, or other mandatory consumer rights.

Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for intentional misconduct, fraud, death or personal injury caused by negligence where applicable, or mandatory consumer rights. Subject to that rule, Kompetr is not responsible for physical games, sports injuries caused by participation, venue conditions, equipment, transport, conduct of other users, decisions made by Administrators or Co-administrators, or information entered by users. To the extent permitted by law, we are not liable for indirect or consequential loss, lost profit, lost opportunity, reputational harm, or loss caused by events outside our reasonable control. Any limitation in these Terms applies only to the maximum extent permitted by the law applicable to the user.

Responsibility for your breach

If your unlawful User Content, misuse of Kompetr, or material breach of these Terms causes a third-party claim or reasonable direct cost, you are responsible for that claim or cost to the extent permitted by law and to the extent caused by your conduct. This provision does not apply where you are a consumer and such responsibility would be unfair or prohibited by mandatory law.

Governing law and jurisdiction

These Terms are governed by Polish law. If you are a consumer resident in the European Union, European Economic Area, United Kingdom, or another jurisdiction with mandatory consumer protections, you also retain the protections that cannot be excluded under the law of your country of residence. Courts with jurisdiction under applicable law may hear disputes. Nothing in this section requires a consumer to bring a claim only in Poland where mandatory law provides another available forum.

Complaints and support

Questions, service complaints, legal notices, and support requests may be sent to hello@kompetr.com. Privacy and data-protection requests should be sent to privacy@kompetr.com. Include your account email, a clear description of the issue, relevant private-group or game information, transaction references where applicable, and the outcome requested. We aim to acknowledge a complaint within 7 days and provide a substantive response or progress update within 30 days. Complex, security-sensitive, or legally sensitive matters may require longer. These voluntary targets do not reduce any shorter mandatory deadline.

Changes to these Terms

We may update these Terms to reflect changes to Kompetr, new features, service providers, security needs, business changes, or legal requirements. The date at the top identifies the latest version. For material changes affecting an existing paid Subscription or users' rights, we will provide reasonable advance notice where required and explain when the revised Terms take effect. Where applicable law requires consent, we will request it. Continuing to use Kompetr after a validly notified change takes effect constitutes acceptance only where permitted by law.

General provisions

If a provision of these Terms is invalid or unenforceable, the remaining provisions continue to apply, and the affected provision will be interpreted or limited as closely as legally possible to its intended purpose. A failure to enforce a provision is not a waiver. You may not transfer your account or contractual rights without our consent, except where mandatory law permits it. We may transfer operation of Kompetr and these Terms to a future registered business or successor, provided that this does not reduce mandatory user rights and users are informed where required.

Operator and contact details

Kompetr is currently operated by Jonasz Adamski, who is not yet operating the service through a registered company. General enquiries, support, complaints, billing enquiries, and legal notices may be sent to hello@kompetr.com. Privacy and data-protection requests may be sent to privacy@kompetr.com. The operator information in these Terms will be updated if Kompetr is transferred to or operated by a registered business.
